Specific Terms of Use for the WhatsApp Communication Channel

Purpose

These Specific Terms of Use ("STU") regulate communications through the WhatsApp application between Defratyka Inc. sp. z o.o. ("Defratyka"), the entity responsible for managing the website homestagr.com (hereinafter, the "Website"), with registered office at ul. Twarda 18, 00-105 Warszawa, Poland, and the user.

A user is understood to be any person who voluntarily interacts with us through the WhatsApp application (hereinafter, the "User").

WhatsApp is an application owned by WhatsApp Ireland Limited. By using this channel to communicate with Defratyka, the User agrees to the terms of use and privacy policy of said application, available at https://www.whatsapp.com/legal/, over which Defratyka exercises no control and assumes no responsibility whatsoever.

This communication channel is the primary method for using Homestagr's AI-powered photo enhancement and video generation services. Users can submit photos via WhatsApp and receive enhanced results directly through the same channel. Additionally, users may access our services through the web application dashboard.

Defratyka reserves the right to cancel this channel or block access to it for any Users who fail to comply with these STU.

Reading these STU is a prior and necessary condition for the use of this channel and implies the full and unreserved acceptance of all provisions contained herein, which are published on the Website. If you do not agree with these conditions, please refrain from using this tool and contact us through any of the other available customer service channels.

Types of WhatsApp Communications

Through WhatsApp, you may receive the following types of communications from Homestagr:

  • Service Delivery Messages: Enhanced photos and generated fly-through videos resulting from your requests.
  • Processing Updates: Status notifications about your photo enhancement or video generation jobs.
  • Account Notifications: Information about your credit balance, subscription status, and account-related matters.
  • Customer Support: Responses to your inquiries and assistance with using our services.
  • AI Assistant Interactions: Conversational responses from our AI-powered assistant to help you use Homestagr services.

WhatsApp Business Platform Compliance

Homestagr operates on the WhatsApp Business Platform and strictly adheres to Meta's policies and guidelines. Our messaging practices include:

  • Using only pre-approved message templates that comply with Meta's guidelines
  • Sending messages only during appropriate hours
  • Respecting message frequency limits and user preferences
  • Providing clear opt-out options for all communications
  • Protecting user privacy in accordance with Meta's requirements and GDPR

Privacy Policy for WhatsApp Communications

When a User voluntarily subscribes to the services of Homestagr and uses this channel, the information provided will be processed for the purpose of properly executing our services, based on their consent and the performance of our service agreement.

Data Processing: Personal data shared through WhatsApp will be processed in accordance with our Privacy Policy. This includes:

  • Your phone number for communication purposes
  • Photos you submit for enhancement or video generation
  • Messages and conversation history for service delivery
  • Account information linked to your WhatsApp number

Data Retention: Communication logs are retained for customer support purposes and service delivery. Photos and processed media are retained to allow you to access your history. You may request deletion of your data at any time.

Third-Party Sharing: By using WhatsApp, your communications are processed through WhatsApp Ireland Limited and Meta Platforms, Inc. infrastructure. Your data may be transferred to servers in Ireland and the United States under Meta's data processing terms. Defratyka does not sell or share your personal data with other third parties for marketing purposes.

Your Rights

We remind you that the applicable data protection regulations (GDPR) grant you a number of rights in relation to the processing of data derived from the use of this channel, in particular:

  • Right of access: To know what type of data we are processing and the characteristics of the processing being carried out.
