By accessing and using Homestagr, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access the service. You must be at least 18 years old to use our services.

2. Service Description

Homestagr provides AI-powered services for real estate professionals, including:

• Photo Enhancement: AI-powered improvement of real estate photos, including clutter removal, lighting enhancement, and line straightening.
• Fly-through Video Generation: Creation of animated fly-through videos from static photos.
• WhatsApp Integration: Ability to submit photos and receive results via WhatsApp messaging.
• Web Application: Dashboard for managing photos, viewing history, and account settings.

We reserve the right to modify, suspend, or discontinue any feature of the service at any time. We strive to maintain high service availability but do not guarantee uninterrupted access.

3. User Responsibilities

By using Homestagr, you agree to:

• Maintain accurate and up-to-date account information
• Protect account credentials and maintain security
• Use the service for lawful purposes only
• Not misuse or abuse the service
• Comply with all applicable laws and regulations
• Only submit photos you have the right to use and process

4. Credits and Payments

Our services operate on a credit-based system:

• All payments are processed securely through our payment providers

Refund Policy: Due to the nature of digital services and immediate credit delivery, purchases are generally non-refundable unless otherwise required by applicable consumer protection laws. If you experience technical issues preventing service delivery, please contact our support team.

5. Intellectual Property

Your Content: You retain full ownership of the original photos you submit. By using our services, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the requested services.

Enhanced Content: The enhanced photos and generated videos are provided for your use. You may use them for your real estate listings and marketing purposes.

Our Service: All content, features, and functionality of the Homestagr platform (excluding your submitted content) are owned by Defratyka Inc. sp. z o.o. and are protected by international copyright, trademark, and other intellectual property laws.

6. WhatsApp Communication Consent

Messaging Consent: By using Homestagr via WhatsApp, you explicitly consent to receive:

• Service delivery messages (enhanced photos, generated videos)
• Processing status updates and notifications
• Account-related communications (credits, subscription)
• Customer support responses

Meta Policy Compliance: We strictly adhere to Meta's WhatsApp Business Platform policies and guidelines. Our messaging practices include:

• Using only approved message templates compliant with Meta's guidelines
• Sending messages only during appropriate hours
• Providing clear opt-out options
• Protecting your privacy in accordance with Meta's requirements

Your Rights: You may opt-out of WhatsApp communications at any time by sending "STOP" or contacting our support team. You can also manage communication preferences through your account settings.

7. AI Processing and Limitations

Homestagr uses artificial intelligence to process your photos. You acknowledge and agree that:

• AI results may vary and are not guaranteed to meet specific expectations
• AI may occasionally produce unexpected or imperfect results
• Processing times may vary based on demand and complexity
• You should review all enhanced content before using it professionally

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our services will be uninterrupted, error-free, or that results will meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Defratyka Inc. sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

10. Termination

By Us: We may suspend or terminate your access to our services at any time for violation of these Terms, abuse of the service, or for any other reason at our reasonable discretion. We will notify you of termination where practicable.

By You: You may terminate your account at any time by contacting us at support@homestagr.com. Upon termination, unused credits may be forfeited unless otherwise required by law.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the service. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of our services after any changes constitutes acceptance of the new Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland. For consumers residing in the European Union, this does not affect your rights under mandatory consumer protection laws of your country of residence.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
